FECA Update

US Office of Administrative Law Judges 
Subject to the assigned ALJ’s discretion, the Order extends the suspension of all in-person hearings through at least July 24, 2020; notifies the public that OALJ will start hearing cases telephonically, by video, or other remote means after May 15, and will restart issuance of decisions beginning on April 16, serving the parties by email

US Dept of Labor

WILG has been working hard over the last few weeks on issues regarding COVID-19.  WILG is the national workers’ compensation bar and we are here to assist this wonderful group of like-minded attorneys in sharing information and resources.  Here are some of the ways that WILG is working to assist our members during this time:

  • There will be a weekly video address on FaceBook Live from President Bill Smith.regarding what WILG is doing and what is going on in the work comp world regarding COVID-19  The video will be on Fridays at 3PM ET each week.  
  • There will be a weekly bulletin sent to members via email, eclips, social media & on our webpage regarding the developments of COVID-19 as it relates to workers’ comp every Monday.
  • WILG has created a web page specifically on COVID-19 with all of the resources WILG has gathered on this evolving issue and it will be updated daily.  Some of the things included are: state by state information regarding hearings & courts for employees and employers (such as if telephonic hearings are being allowed or if all hearings are cancelled,) which states are deeming attorneys as essential, statute of limitation extensions in states, etc. 
  • WILG is hosted a webinar that will cover: how to handle COVID-19 as an employer, how to continue to run your practice, what to do if a worker is injured by COVID-19 on March 31
  • WILG offered an online seminar by JustWorks to address specific Human Resources questions on March 25
  • We hosted a tele-roundtable discussion for WILG members to share concerns and information on April 7, 2020 and are developing more for future dates.
  • WILG is working with SBA Loans to provide low interest loans and bridge loans quickly for its members. Complete this form 
  • WILG is working with another partner to provide loans that are less restrictive.  More details to come.
  • WILG is working with Ametros for Ametros Banking to help those with clients who have no other access to checking or savings accounts.
  • WILG will be providing information and potentially a service to streamline client communication to provide effective client support and allow attorneys to communicate easily with all clients simultaneously.
  • WILG is exploring e-wallet options for clients so they can receive their money directly.
  • WILG is also exploring options with a tele-medicine company to assist in clients getting the healthcare and appointments they need.
  • There will be several online CLE’s provided on ethics and other topics over the next few months to provide members who need credits with options.
  • Live streaming of the convention will be an option for members this year. 
  • As always we have an active listserv with amazing attorneys to share information and support. We are all in this together and there is strength in working together as a community and supporting each other.
  • Additionally we have professional staff and a research director to assist members at any time.

Housekeeping:

  • WILG Officers & Staff are meeting weekly to discuss current events and determine WILG’s course of action and ensure viability of members’ practices and benefits for clients.
  • WILG held board meeting by teleconference on April 2. 
  • The Cherry Blossom Lobby Day was cancelled for 2020
  • The WILG Dinner that is in conjunction with the ABA & CWCL has been postponed to March 19, 2021 at The Gallery Venue in NOLA.
  • We worked with Loyola and the ABA to schedule our Southeast and Longshore Conferences on March 19-20, 2021.

 At XcelABLE, we are still offering functional assessments or functional capacity evaluations for all injured workers in our Los Angeles and   San Diego locations. We have found that many of the federal workers are still working and need this service to return-to-work.  We have   condensed our locations to two locations in Los Angeles and one in San Diego.  Within each of these areas, we are also able to provide surface   EMG testing to assess for muscle fatigue and endurance losses.  We are using all necessary precautions for COVID-19 in each of these clinics   and are providing a properly sanitized location with contact with only one provider.  In addition, we are able to perform remote functional testing through self-based questionnaires such as the Work-Ability Index (WAI) and other measures that have been researched for overall effectiveness in testing work ability that do not require a direct contact with the injured worker.  We are also providing remote ergonomic training programs and evaluations through a web-based and mobile based platform.
